CONSIDER THE REPORT OF THE COMMUNITY DEVELOPMENT COMMITTEE

  1. The City Council award $70,000 to City of Minot for Council Chambers AV upgrades and ADA improvements
  2. The City Council award $392,500 to Minot Recreation Commission to replace the Auditorium flooring and lighting
  3. The City Council award $550,000 to City of Minot for structural repairs to the Carnegie Center
  4. The City Council award $1,000,000 to Minot Park District & Children’s Museum of Minot toward the Magic City Discovery Center subject to the condition requiring the entity to raise 50% of the awarded funds by December 31, 2018
  5. The City Council award $1,000,000 to Minot Park District & Roosevelt Park Zoo toward new habitats for the big cats at Roosevelt Park Zoo subject to the condition requiring the entity to raise 50% of the awarded funds by December 31, 2018
  6. OTHER BUSINESS

14.I.

1603 7TH AVE SW (PESKEY) ACQUISITION AGREEMENT (ACQ 136)

The land at 1603 7th Ave SW is required as part of phase 2 of the MREFPP. Initially, an agreement was not able to be reached on price via the normal administrative process and appeal, so it entered the judicial process. At the initial court meeting on April 28, 2017 the Peskeys agreed to transfer ownership and receive $300,000 (appraised value), however the judge also set a trial date of Aug 7th to decide the final compensation because the Peskeys wanted $700,000. In the meantime, a settlement agreement has been reached between the parties of $325,500. The Small Business Association has financial interest in the property via loan, and their appraisal was $322,000.
  1. Recommend approval of the proposed settlement agreement to finalize acquisition of the property located at 1603 7th Ave SW - needed for the flood control project; and
  2. Authorize John Warcup to sign the agreement as Special Assistant City Attorney, on behalf of the City of Minot
